The 2009 Food ‘Safety’ Bills Harmonize Agribusiness Practices in Service of Corporate Global Governance

By Nicole Johnson
“I think it’s time to de-professionalize the public debate on matters that vitally affect the lives of ordinary people. It’s time to snatch our futures back from the “experts.” Time to ask, in ordinary language, the public question and to demand, in ordinary language, the public answer.” – Arundhati Roy, Power Politics
It’s enough to make you so queasy you lose your lunch. HR 875, the “Food Safety Modernization Act of 2009,” is a head-spinning piece of legislation that would radically change the structure of the US government’s regulatory agencies, usurping states rights to federalize food inspection and determine what agricultural practices are permissible. Considerable concern has been voiced about what this bill would mean for small and medium sized farmers, organic farming, the future of conventional and organic seeds, the food localization movement, and even home gardens. HR 875 would give regulators the power to enter private property, which is conveniently redefined as “premises,” and impose enormous fines for noncompliance. Though not discussed in the corporate media, numerous articles about it appear on the internet, launching a debate about whether or not Monsanto is behind the bill.
In response to these articles, Brad Mitchell, a member of Monsanto’s public relations staff who writes for the company’s new blog — a less-than-stealth effort to counter the public’s deep distrust of the predatory corporation — has gone on record stating that Monsanto has absolutely nothing at all to do with the bill.
Brad’s assurances aside, experience dictates that taking Monsanto at its word is patently foolish. But for those who need a bit more proof, like the Organic Consumers Association and Food and Water Watch, let’s settle the issue, once and for all: Who crafted the legislation and what do they hope to gain by it? Would it really make our food safer as it claims, or would it make mandatory the industrial agricultural practices that are the root cause of the food-borne illnesses it claims to vanquish? And what else might be at stake?
After a series of well-publicized cases of food contamination – E. coli-tainted meat, melamine-adulterated pet food and baby formula, salmonella-infected peanut butter – the public has been well primed to look toward Congress to fix a poorly funded and insufficiently staffed food safety inspection system. And, right on cue, a crop of “food safety” bills gets dumped our way. The most controversial and transformational of these pieces of legislation, Congresswoman Rosa DeLauro’s HR 875, can be traced directly to recommendations made by the Trust for America’s Health, a non-profit organization sponsored by the Robert Wood Johnson Foundation.
The Trust for America’s Health has produced reports that serve as blueprints for a major restructuring of the agencies involved in overseeing food safety policy as well as eye-popping changes to the public health system. Its recommendations also have also made their way into the other food safety bills that have been recently introduced in Congress: SB 425, the “Food Safety and Tracking Improving Act;” HR 814, the “Trace Act of 2009;” and HR 759, the “Food and Drug Administration Globalization Act of 2009.”
While the vaguely worded HR 875 gives the appearance of being a reasonable attempt to fix the problems outlined, a close inspection of the blueprints on which they are based –and a bit of knowledge about the industry players who crafted them — reveals critical clues about how the public health system would be transformed for the benefit of biotech, pharmaceutical and agribusiness giants. Non-profit foundations have long served as effective tools for corporate wealth to influence public policy, providing the means to guarantee outcomes that enrich corporations at the public’s expense. The global pharmaceutical and consumer product company Johnson & Johnson’s tax-exempt foundation is no different.
Tayloring the Message: The Trust for America’s Health
The public should familiarize itself with three key reports produced by The Trust for America’s Health: “Keeping America’s Food Safe: A Blueprint for Fixing the Food and Safety System at the US Department of Health and Human Services,”(1) “Fixing Food Safety: Protecting America’s Food Supply from Farm-to-Fork,”(2) and the “Blueprint for a Healthier America: Modernizing the Federal Public Health System to Focus on Prevention and Preparedness.”(3)
President Obama’s nominee for Commissioner of the Food and Drug Administration Margaret Hamburg, MD, sits on the board of directors at the Trust for America’s Health. Hamburg, a well-connected player in the public health field, also serves on the board of directors of the Rockefeller Foundation. Among other things, the Rockefeller’s vast fortune is responsible for funding foundations and institutes that spread unsafe genetically-engineered food crops around the world.(4) Sadly, those who hoped that Obama’s election would herald positive changes have repeatedly found themselves duped: the deep corporate ties of his appointees guarantee a continuation of corporate control over the US government, a veritable concierge service on steroids for private interests.
A notable craftsman at the Trust for America’s Health is none other than the notorious Michael R. Taylor, JD. Taylor penned a paper included as an appendix of “Keeping America Safe: A Blueprint for Fixing the Food Safety System at the Department of Health and Human Services” called “Restructuring Food Safety at HHS: Design and Implementation.” In it, Taylor prescribes the creation of a new Food Safety Administration that consolidates all safety functions formerly performed by a host of other government regulatory agencies and institutes on a federal level the use of industry-friendly “risk assessment” methods.
Monsanto’s Jack of All Trades
Most people who know Michael Taylor’s name recall that he worked as Monsanto’s lawyer at King & Spalding for years before being appointed to the FDA to oversee the swift introduction into the marketplace of GMOs. He did so by ramming through a faux scientific regulatory conceit called “substantial equivalence.”
Industry-independent scientists have rightly criticized the concept of substantial equivalence as an inappropriate method for determining safety, calling it “a pseudo-scientific concept because it is a commercial and political judgment masquerading as it if were scientific. It is, moreover, inherently anti-scientific because it was created primarily to provide an excuse for not requiring biochemical or toxicological tests. It therefore serves to discourage and inhibit potentially informative scientific research.”(5)
FDA scientists at the Division of Food Chemistry and Technology wanted to see testing performed to ensure that GMO foods didn’t increase levels of naturally occurring toxins, create new, previously unidentified toxins, increase the tendency to gather toxic substances from the environment such as pesticides or heavy metals, and alter the level nutrients.(6) Ignoring their scientific objections, the politically-appointed Taylor let loose GMO technology on the nation of guinea pigs without requiring any legitimate safety and toxicology investigations to protect public health. He also ensured that the public would remain ignorant of GMOs in their food by instituting a no-labeling policy. Now, almost 80% of the food sold in grocery stores contains GMOs. Monsanto subsequently rewarded Taylor for his government work by making him its Vice President of Public Policy.
These days, we find that Taylor has morphed from Monsanto’s VP into a “research professor” at George Washington University School of Public Heath and Health Services. He also spends his time writing policy at a number of industry-funded think tanks, including Resources for the Future, Resolve Inc, the Food Safety Research Consortium, and the Alliance to End Hunger,
Those who are concerned about what the Organic Consumers Association calls the real Monsanto bill, The Global Food Security Act (SB 384), can see Taylor’s contribution to that piece of legislation by reviewing a report he wrote for a think tank called the Partnership to Cut Hunger and Poverty in Africa. The report, “Beating Africa’s Poverty By Investing in Africa’s Infrastructure,”(7) supports the expansive agenda of biotech firms. The organization is funded in part by the Rockefeller and Gates foundations, and Taylor’s work product provides the rational for SB 384.(8) According the organization’s website, it aims to “implement Partnership activities to strengthen agricultural and rural enterprises and to facilitate their integration into regional, national and global markets” by bringing together “core representatives from U.S. and Africa-based private and public organizations who have experience with Africa’s agriculture and trade-related issues.” To give him credit, Taylor is relentless and prolific. If only his work sought to empower rather than enslave.
Since shedding the title of Vice President of Monsanto, Taylor has been busy promoting the concept of “risk assessment” as a means to deal with food-borne illness as an alternative to urging regulatory agencies to actually enforce laws already on the books and to adequately fund them so they could do so. Like “substantial equivalence,” the risk assessment conceit offers a great opportunity to change the system to benefit corporate interests. Taylor has spent years churning out the necessary conceptual building blocks in cross-pollinating think tanks and foundations to create the intellectual framework for legislative proposals like these food “safety” bills.
The reports produced by the Trust of America’s Health rely heavily on “risk assessment, management and communication,” a form of message control hatched at the Harvard Center for Risk Analysis, a corporate-funded affair that provides “scientific” justification for a wide range of policies corporations want to see implemented. Using this method of risk analysis, the necessary justification can be produced for just about whatever outcome is wished by the underwriters.
It’s no real surprise that Taylor’s think-tank-funded policy on risk assessment, like his report “Food Safety Updated: Developing Tools for a More Science- and Risk-Based Approach,”(9) underwritten by the Milbank Memorial Fund and Resources for the Future, has been embraced and institutionalized by the Codex Alimentarius Commission.
Codex – A Tool of Global Governance by Corporate Command
If some variation of this batch of bad bills is passed into legislation, US citizens will find their laws considerably closer to becoming harmonized with Codex Alimentarius, a set of international food codes crafted by unaccountable and unelected bureaucrats in conjunction with vested industry and trade interests. It’s important that the public learns more about Codex, because its “standards” will be enforced by the World Trade Organization to govern global trade practices of all its member nations. Furthermore, this body of food codes will take legal precedence over national laws, like the 1994 Dietary Supplement Health and Education Act (DSHEA).
The US media are assiduously silent on the matter of Codex. Under the helpful cover of the media’s information blackout, Codex Alimentarius Commission meetings are regularly attended by officials from the Departments of Agriculture, Health and Human Services, State, Commerce, the Environmental Protection Agency, the Office of US Trade Representative, and the US Codex Office. Non-governmental agencies in attendance at the meetings include the 49th Parallel Biotechnology Consortium, the Biotechnology Industry Organization, Consumers Union, Crop Life International, Dow Chemical, Dupont, the European Association of Bioindustries, the Grain and Feed Trade Association, the International Cooperative Alliance, the International Council of Beverages Associations, the International Council of Grocery Manufacturers Association, the Institute of Food Technologists, the International Glutamate Technical Committee and the International Life Sciences Institute, Monsanto, and Sygenta, among others –with the exception, that is, of any democratically elected and accountable representatives of citizens these food codes will affect.
The standards created by the Codex Alimentarius Commission are set to enable industry interests to dictate and control rules covering vitamins, minerals and nutrients, genetically modified plants and livestock, toxic residues, antibiotics, drugs, growth stimulants and other hormones in food and animals, organic foods, the irradiation of plants and animal food and nanotechnology. Scott Tips, President of the National Health Federation, the only accredited health freedom organization allowed to participate at Codex meetings, projects that these standards are on tract to be implemented sometime between 2011 and 2013.
Codex committees — such as the Codex Committees on Food Additives and Contaminants (CCFAC), Pesticide Residues (CCPR), Residues of Veterinary Drugs in Foods (CCRVDF), Food Hygiene (CCFH), General Principles (CCGP), Food Labeling (CCFL), Nutrition and Food for Dietary Uses (CCNFDU), Import and Export Inspection and Certification Systems (CCFICS) and Methods of Analysis an Sampling (CCMAS) – all employ the concept of risk management to determine the rules they recommend to the Codex Alimentarius Commission (CAC).
Codex standards are of critical importance to agribusiness, because they are acknowledged as the appropriate guidelines in the Sanitary and Phytosanitary (SPS) and Technical Barriers to Trade (TBT) Agreements of the WTO Agreement. While the WTO had provisions that allowed member states to create barriers to trade by citing national legislation to ensure food safety, those provisions would become void, thanks to the SPS and TBT agreements, if an international safety standard created by Codex determined otherwise. So, thanks to the unelected and unaccountable private deal-makers who wrote these trade agreements, Codex rules will trump national law.
Meet the Missus — Christine Lewis Taylor
Undermining US law for the benefit of multinational corporations is a family affair in the Taylor household. To see how the concept of “risk assessment” can be usefully abused, let’s look at how Mrs. Michael Taylor adopts the conceit to her purposes.
Christine Lewis Taylor, a veteran FDA employee, has been busy working up the “scientific” justification for placing a cap on the level of nutrients people should be allowed to consume. To do so, she pushes a perverse concept that defines nutrients as toxins. In other words, Mrs. Taylor would like us all to believe that the vitamins and minerals needed by cells throughout the body in order to function and detoxify should be considered hazardous, requiring governmental oversight that would limit people’s exposure to them under law.
After a stint heading up the Codex delegation on the Committee on Food Labeling and another as a delegate to Codex’s Committee on Nutrition and Foods for Special Dietary Uses, Christine Lewis Taylor was farmed out by the Institute of Medicine to the World Health Organization, where she played an instrumental role as Project Director in applying the risk assessment model to redefine nutrition as we know it. Her mission: To develop the framework whereby an “upper safe limit” would be set, defining the amount supplements the public should be allowed to purchase except by prescription. In her WHO capacity, she organized a seminar, selected the scientists who would be allowed to participate in it, and oversaw the group’s published conclusion.(10)
US law regulates supplements as food. But the pharmaceutical industry wants to change that and have supplements regulated as drugs, and bureaucrats like Mrs. Taylor are doing what they can to comply. Taylor argues that people are exposed to too many nutrients and wants to see the establishment of a one-size-fits-all international standard set that stipulates how much of each nutrient people need, a amount that in some cases is less than the already established recommended daily allowances.(11)
But the good news, at least for pharmaceutical companies, is that there would be more profit to be made in treating a host of vitamin-deficiency diseases. And, once these guidelines are adopted by Codex, people would no longer have the freedom to purchase therapeutic amounts of dietary supplements to compensate for a nutrient-deficient and legally poisoned food supply to which we’re subjected. Supplements would no longer be consider food as they are under DSHEA but instead would be regulated as drugs, available only by prescription or in amounts so limited as to render them insufficiently helpful in the prevention of disease.
People are subject to disease not because they are deficient in pharmaceuticals. We are subject to disease because we either do not get the nutrients we need from our food sources or because we are exposed to environmental toxins and harmful food adulterants like hydrogenated oils, high fructose corn syrup, MSG, pesticide residues, aspartame, and GMOs, falsely deemed safe by the FDA. These adulterants contribute directly to a long list of predictable degenerative diseases. But thanks to the tireless work of Mrs. Taylor, the chemical cartel will get wealthier by making us sick and wealthier still by treating us for illnesses its products cause.
Sweeping Inconvenient Facts Under the Rug
In addition to her work toward the implementation of Codex, it’s worth noting that Christine Taylor Lewis has done her part to rewrite history to make her husband’s tenure at the FDA to appear less corrupt than it, in fact, was. Talk about housekeeping. While serving as the thesis advisor to a Tuft’s university student, Taylor oversaw the details of a dissertation entitled the “Labeling of Genetically Modified Foods: Stakeholder Perceptions of the Food and Drug Administration’s Public Consultation Processes and Food Industry Reactions to the United States Voluntary and European Union Mandatory Policies.”(12)
This thesis belongs to Janice Lee Albert, who happened to be an employee of the UN’s Food and Agricultural Organization in Rome while working on her dissertation. Albert’s dissertation focuses on the controversy over labeling GMOs, a topic that deeply involved Michael Taylor, her thesis advisor’s husband. However, that marital relationship is never disclosed in the dissertation. In fact, while Mr. Taylor’s work is described throughout the dissertation, Albert fails to identify him by name as a key participant in the controversy. On the contrary, when Michael Taylor is – finally – mentioned by name, it is as one of twenty-four people Albert interviewed to obtain their views on the appropriateness of the FDA’s labeling decisions. Astonishingly, Albert identifies Michael Taylor as an “Independent Expert,” revealing nothing about the fact he (1) previously worked as a lawyer for the company who’s product was getting special treatment or (2) the fact that he was the one in charge of implementing the concept of “substantial equivalence” at the FDA or (3) went to work for Monsanto afterwards.
Under Christine Lewis Taylor’s supervision, Albert’s thesis defends the FDA’s controversial labeling decision and its consultation processes with the public as being “conducted as intended by law.” Albert claims that members of the public who are dissatisfied with the FDA’s decision not to label GMO products just don’t understand the all the factors that go into making decisions at the FDA. She’s probably correct on that point: Most of the public is under the mistaken assumption that the FDA has a responsibility to protect it from the unsafe products of an untested technology. Thanks to her explanation, at least we now know that certain employees of the FDA consider their only legal obligation is to offer the public an opportunity to voice its concerns, not act upon them.
Albert contends that the exact nature of the public concerns about GMOs was outside the scope of her dissertation and therefore unnecessary for her to address or even note. Nevertheless, a thorough pre-market study of the health risks associated with GMOs should never have been outside the scope of the FDA’s responsibilities.
Scientists and journalists have lost their jobs for daring to cross the powerful biotech industry to publicize the health risks of GMOs.(13) The well-controlled media dutifully ignores the pile up of evidence of the nature of the dangers. In recent months, research has been published showing that GM corn increases infertility (14) and that the key ingredients in Monsanto’s Round-Up Ready, the herbicide used on all GMO crops, cause death to human cells.(15)
Given what we now know about the dangers of GMOs, we should dispense with the discussion of whether or not to label them and move right to the topic of banning them altogether.
Identifying What Ails Us
Americans should be able to have confidence that the food they eat is safe. The Trust for America’s Health, however, is using recent food-borne illness events as an excuse to make radical and unnecessary changes to a regulatory system has been purposely underfunded and understaffed.(16) While focusing exclusively of food borne illnesses, it has ignored the predictable diseases suffered by millions that are caused by the chronic consumption of foods adulterated with ingredients that an industry-dominated FDA deems to be GRAS, that is, “generally regarded as safe.”
Restoring and protecting our health requires a real understanding about what ails us. To put things in perspective, food borne illnesses are responsible for some 5,000 death a year; but over 700,000 people die each year from government-approved medicine(17), and millions more suffer from predictable diseases that could be prevented if we had a safe, clean, whole-foods based food supply. If we allow those behind the food “safety” bills to use this crisis as an opportunity to change the food safety system, transnational corporations will have even more control over our health than they do now.
Prevention, as they say, is the best cure.

Don't Clearcut Oregon's Forests

As a child growing up in rural Oregon, I spent countless hours enjoying all of the outdoor splendor of my home state's wildlands. Hiking and camping with my family, I enjoyed being out amidst Oregon's towering old-growth trees. To this day, I marvel at trees that have stood in Oregon's forest for hundreds of years.
The trees in Oregon's forests are a national treasure in my mind. That's why I'm so upset at a Bush-era plan to open more than 2.5 million acres of public forest land in Oregon up to logging.
It all stems from a Bush Administration agreement with big timber called the Western Oregon Plan Revision (or WOPR). In 2007, Bush released a draft of this plan -- and 27,000 people commented, demanding that the Bureau of Land Management act to save the forests. But the BLM ignored their pleas.
The Sierra Club Oregon's website lists what will happen to western Oregon's forests during the first decade if the WOPR isn't stopped. They say the WOPR will:
1. Remove BLM forests from the scientific framework of the Northwest Forest Plan.2. Ramp up clearcut logging across hundreds of thousands of acres and get over 70% of the timber volume from clearcuts.3. Reduce streamside buffers that protect clean water and fish by 50%.4. Log some of the last remaining older forests in western Oregon.5. Increase logging by nearly 400% compared to current logging levels.6. Add 180 million tons more carbon to the atmosphere compared to no logging (equivalent to the greenhouse gas emissions from 1 million cars driven for 132 years).7. Result in 1,300 miles of new logging roads.
The Wilderness Society is leading the charge, asking Secretary of the Interior Ken Salazar to stop this plan. In a blog post on their site, the Wilderness Society writes: "The fate of over 2.5 million acres of forest, which is home to over 1,000 different wildlife species, now lies in the hands of the Obama Administration. President Obama and Interior Secretary Ken Salazar have pledged to restore scientific integrity and ethical responsibility to public lands management. To live up to their pledge, the administration should act based on science, law and the interests of the American people and withdraw Bush’s WOPR."
I couldn't agree more. If you've ever visited Oregon's forests, you know just how majestic they are. If you haven't, you're really missing out on an amazing display of our natural world. Either way, please join me in urging Secretary Salazar to stop the plan to clearcut Oregon's forests.

The Intel ISEF 2009 Combines the Two Most Wonderful Things in the World: Science and Kids

Well, the Intel International Science and Engineering Fair is over leaving me somewhat hollow inside. I will now leave the world of brilliant, talented high school students devoting their considerable talents to solving the world’s problems, to return to the world of mediocre, miserable adults who create the world’s problems.
Seriously, seeing all of these kids and their projects is really interesting and amazing. Take all of the science in the world, infuse some rather intense youth energy into it, support the kids so they can do whatever work they want, give them just enough structure to keep them from blowing things up, and then let them cut loose and have fun every once in a while (they even had a couple of dance nights for the kids). In the end you are left with the awe and certainty that combining youth with science is one of those things in this world that really works and works well.
So, those being the two chief elements to Intel’s formula, let me leave you with two video demonstrations of that. First, the science, or what Li Boynton had to say about it.
Li Boynton on Science
Li was one of three winners of the ISEF top prize which is a $50,000 scholarship. Or, as Li will be calling it when the patent goes through, “chump change”. Her experiment was to develop a bio-sensor from bioluminescent bacterium which attaches itself to pollutants and glows so you can see if a sample of water is polluted. Whoa.
Next is the Puerto Rican team showing us some youth energy worthy of “Fame“. Puerto Rico esta aqui! I have never seen teenagers so unafraid to have fun and not be self-conscious.
Puerto Rican Team Having Fun
They make me think I was born in the wrong country.
I say this as a compliment, these kids are geeks. Not just because they’re brilliant, but because they’re not afraid to be brilliant or enthusiastic. Or, in the words of GeekDad favorite Marian Call:
“I will never play it cool, so I will never once be bored.”
Thanks one last time to Kara Gaffney (twitter.com/kgaffney) and Kiesha Cochrane (twitter.com/kfcochrane) and all the folks at Intel PR for all their help and support during the fair

5 reasons why Independence Day is the Geekiest Holiday of Them All

Independence Day is secretly a great geek holiday. Underneath all that grilling and baseball and apple pie is a holiday dedicated to those inventors and makers who dedicated themselves to the proposition that all men are created equal. So while you’re at the beach, or the stadium, or while flying your awesome 3D Star Wars Starfighter Kites, pour a cold one in honor of these five* geeky reasons to celebrate the 4th of July:
5. Two if by sea: David Bushnell’s Turtle and Abraham Lincoln’s scheme for a floating drydock. In 1776, Bushnell invented this one-man submarine-cum-bomb-deployment mechanism for sabotaging British ships. Meanwhile, Lincoln is the only president to own a patent, though he failed to monetize it. (I’m assuming this doesn’t include Al Gore, who invented the internet and then won a presidential election.)
4. It’s a little-known fact that America was actually founded by the characters of Independence Day.
3. Fireworks. Especially Even when they’re illegal.
2. Summer Fun: No list of Founding Geeks would be complete without Thomas Jefferson and Benjamin Franklin. This weekend, in the spirit of grilling out by the pool, let’s pay tribute first to Thomas Jefferson’s dumbwaiters and wine elevators. They bring you food and drink, almost automagically. Don’t forget Franklin’s swim fins. What could be geekier than inventing–as an eleven year old–the idea of swim fins, and implementing it yourself? Not much. (More Franklin inventions.)
1. Family: In The Invention of Air: A Story of Science, Faith, Revolution, and the Birth of America, Steven Johnson makes the connection between geekery and freedom explicit: “In the popular foklore of American history, . . . the founders’ various achievements in natural philosophy–Franklin’s electrical experiments, Jefferson’s botany–serve as a kind of sanctified extracurricular activity. They were statesmen and political visionaries who just happened to be hobbyists in science, albeit amazingly successful ones. Their great passions were liberty and freedom and democracy; the experiments were a side project. But the Priestly view suggests that the story has it backward.”
As a backdrop to this larger point about the interconnectedness of science, reason, politics, and faith, The Invention of Air has some great descriptive riffs on Joseph Priestley’s home laboratories, and his efforts to do his work amid the tumult of professional and family life. The very last words of Johnson’s book, from the acknowledgments, tie the activities of Founding Father to modern GeekDad:
Joseph Priestley lived in a world dramatically different from the one I live in, but the one aspect of his life that seems immediately familiar lies in his descriptions of life at home with Mary and the kids: writing in a house filled with the boisterous play of children; the daily intellectual camaraderie of sharing ideas with a lifelong partner.
On Johnson’s account, that boisterous play of children is not an impediment to, but a powerful engine of, creativity. Which is what GeekDad is all about!

I know the canonical number of items for a blog list is 10, but the steak’s not going to burn itself. Have a great holiday!

Muhammad The Messenger of Allah(May Allah praise im)

All praise be to Allah the Lord Sovereign1 of the universe and may Allah praise His Prophet Muhammad and his household.
Muslims assert that the Prophet Muhammad ()2, is without doubt the greatest individual in history. This is not a baseless claim. Whoever studies his biography and learns the truth about his character and personality, keeping aside all prejudices will reach this conclusion just as some impartial non‐Muslims have reached this conclusion as well.
The late Professor Hasan Ali, may God have mercy on him, said in his magazine ‘Noor al‐Islam’ 3that a Brahmin colleague of his once told him: "I recognize and believe that the Messenger of Islam is the greatest man in history." Professor Hasan Ali, may God have mercy on him, asked him: "Why do you consider him as the greatest man?" He replied:
No man possessed the excellent characteristics and ethics that he possessed all at one time. He was a king under whom the entire peninsula was unified yet he was humble and believed that all dominion belonged to God alone.
Great riches would come to him and yet he lived in a state of poverty and asceticism since fire would not be lit in his house for
1 Allah is the word for "the God" and "the Deity" in Arabic. The l word Rabb has no proper equivalent in English. and means the Lord, Creator, Owner, Master, King, Fashioner, Provider, the One upon Whom all creatures depend for their means of subsistence, and the One Who gives life and causes death.
2 This Arabic term means, "may God praise him and render him safe from all evil, and sometimes is translated as "may Allah’s peace and blessings be upon him

many days and he would stay hungry. He was a great leader since he was able to lead only a few hundred into battle against thousands, and yet he would decisively defeat them. He loved peace agreements and would agree to them with a firm heart, even though he had thousands of his brave and courageous Companions by his side each one of whom by his conviction could confront a thousand enemies alone while not feeling the least bit intimidated. Yet the Prophet was kind‐hearted, merciful, and did not want to shed a drop of blood, and rather preferred peace. He was deeply concerned about the affairs of the Arabian Peninsula yet he did not neglect the affairs of his family, household, or of the poor and needy. He was keen to disseminate Islam among all those who had gone astray whether far or near. In general, he was a man concerned with the betterment and well being of mankind, yet he did not indulge in amassing worldly fortune as many leaders do. He busied himself with the worship of God and loved doings deeds which pleased Him. He never avenged himself on account of personal reasons. He even prayed for his enemies’ well being and would warn them of the punishment of God.
He was an ascetic regarding worldly affairs and would worship God throughout the night. He was the brave and courageous soldier who himself fought with the sword and conquered nations for the sake of God. He slept on a mat of hay and a pillow filled with coarse fibers. People crowned him as the Sultan of the Arabs and King of the Arabian Peninsula1 yet his family lived a simple life for even after they received great fortunes the riches were piled in the Mosque for distribution. Once, his daughter Fatima complained to him about how the strenuous work that she did at the grinding stone and by transporting the water vessels which had left marks on her body…yet he still did not give her a portion of the gained wealth but instead taught her a few words and supplications. His Companion Umar2 came to his house and looked in his room, and

saw nothing but a straw mat that the Prophet was sitting on, which had left imprints on his body. The only provisions in the house were a handful of barley and a water skin that hung on the wall ‐ this is all the Messenger of God owned at a time when half the Arabs were under his control. When Umar saw this, he could not control himself and wept. The Messenger of God () said:
"Why are you weeping O Umar?" He replied: "Why shouldn’t I weep when Khosrau and Caesar enjoy themselves in this world and the Messenger of God () only owns what I see!" He responded: "O Umar, wouldn’t it please you that this (worldly life) be the share of Khosrau and Caesar in this life, and in the Hereafter this pleasure would be for us alone?"
When the Prophet examined his troops prior to the conquest of Makkah, Abu Sufyan, an enemy of Islam at that time, stood beside al‐Abbas the uncle of the Prophet () and they looked at the banners of the Muslim army. Abu Sufyan The vast number of Muslims amazed Abu Sufyan for they advanced towards Makkah like a torrent of water. No one could stop them and nothing stood in their way. Abu Sufyan then said to al‐Abbas: ‘O Abbas, your nephew has become a great King!’ Al‐Abbas responded saying: ‘This is not kingship, rather prophethood, and the Messangership of Islam.’
A’dee at‐Ta’ee, the son of Ha’tim at‐Ta’ee who is the paradigm of generosity, was present in a gathering of the Prophet () when A`dee was still a Christian. When he saw how the Companions honored and respected the Prophet (), he was confused ‐ was he a Prophet or a king? He asked himself, "Is he a king or a Messenger of the Messengers of God?" While he was pondering over this, a destitute woman came to the Prophet () and said: "I wish to tell you a secret." He said to her: "In which road in Madeenah do you want me to meet you?’ The Prophet () left with the destitute women and took care of her needs. When Ad’ee saw the humbleness of the Prophet (), he realized the truth and discarded the crosses that he was wearing and became a Muslim.ʺ

We will mention some statements of the Orientalists concerning Muhammad (). As Muslims we firmly believe in the Prophet () and his Message and do not need the statements of non‐Muslims to establish this fact, but we mention these statements for the following two reasons:
a. To serve as a reminder and admonition for the nominal Muslims who have abandoned their Prophet and his teachings, perhaps they will take heed and return to their religion.1
b. To inform non‐Muslims about the Prophet from statements of other non Muslims, so that they will be guided to Islam.
I ask all readers to not hold any prejudices when searching for the truth, whether it be here in this booklet or any other Islamic material. I ask God to open their hearts to accept the truth, to show them the right path and inspire them to follow it.

Miami Ice: A world of frozen tropical treats

BY DINKINISH O'CONNOR
promiscuouspalate@yahoo.com
No offense, Fudgie the Whalers, but Carvel is so passé. So, is Mr. Frosty.
So what's a sweltering South Florida waffle coner to do? Flee to the icy, cream-capped cones of Nicaragua, Haiti, Peru, Brazil and Jamaica to enjoy a trendy, tropical ice cream experience without leaving home.
NICARAGUA
At Raspados Loly's on Flagler Street, the frozen treats are a journey to Nicaragua. The venue is like an old-school ice-cream shop with its antique popcorn machine, candy display case and kiwi-colored bench.
Inside, manager Mañuel Duque prepares the house favorite: relleno. Duque scoops a layer of shaved ice into a foam cup and adds crumbled Entenmann's pound cake, lathering it with dulce de leche. He repeats the process twice for an icy, crunchy, three-layer treat that is a textural pillage of the ubiquitous ice cream sundae (16 ounces $4.50, 20 ounces $6; cakeless version $2.50-$6).
''Relleno is sold throughout Nicaragua in these ice cream carts one person pushes with a bell,'' says customer Angela Hirsch Rizo, who enjoyed it in her native Matagalpa. ``I can remember buying it at a lady's house after school.''
You can trade dulce de leche for other fillings: mango, limon, fresa (strawberry), pineapple, tamarind or jocote (a mild-tasting red cherry). There's also the raspado -- tasty, syrup-drenched shaved ice in flavors like sour green apple, blue raspberry and piña colada (small $2.50, medium $4.50, large $6).
Inside a freezer bin, Duque points out Colombian novelties -- adorably tiny, pudding pops in unusual flavors like peanut-coconut combined ($1.50 each). But they're not the main attraction.
''People eat relleno for dinner,'' he says. ``And for memory.''
HAITI
Ferere Bakery is one of many neighborhood Haitian bakeries that delineate North Miami's West Dixie Highway. Outside, there is a colorful walk-up window with display cases of Haitian patties. Inside, the crisp, white walls embrace floral-decorated cakes, peanut brittle and tubs of freshly made ice cream (cones $1, bowls $3, pints $4) that ''reflects the fruits we grew up with in Haiti,'' says co-owner Frantz Lormine.
The corossol (soursop) and sweet sop taste and smell like The Caribbean. The rum raisin is more rum than raisin. There's also mango, vanilla and grenadia (passion fruit) that tastes like late-harvest riesling.
''Delicious,'' says customer Marie Noel, a native of Port-de-Paix. ``It reminds me of Haiti.''
PERU
Walk into Mi Peru Restaurant and you feel like you're in a scene from Y Tu Mama Tambien. The red tabletops, vibrant paintings and coquettish Spanish banter add a frisson of excitement to devouring a cup of Homemade Ceasar's Ice Cream (8 ounces, $4.50).
Sold in a bin in the back of the restaurant, they are reminiscent of those Italian ice cups you used to eat with a small, wooden paddle stick. The maracuya (passion fruit) tastes like sweet cream, peaches and lychee, and the lucuma is like a spiced pumpkin pie. It's so yummy.
Cesar Rengifo, who is originally from Lima, has been making Ceasar's Ice Cream in a Lauderdale Lakes factory for eight years. ''Lucuma is a fruit exclusively grown in Bolivia, Chile and Peru,'' says Rengifo.
Other flavors include custard apple (guanabana), cherimoya and chocolate.
''The lucuma is special to us,'' says customer George Verastegui, a native of Huancayo who has been coming to the restaurant for 28 years.

Man pleads guilty in frozen chicken scam

By MICHAEL KUNZELMAN
Associated Press Writer
NEW ORLEANS -- A man who was deported by Canada last year pleaded guilty Wednesday to charges he duped the Egyptian government into paying more than $7 million for a shipment of frozen chicken he never intended to deliver.
Alexander Legault, 59, had moved from Louisiana to Canada before a grand jury in New Orleans indicted him on fraud charges in 1986. Legault, who also has been charged with participating in scams in Texas and Florida, was ordered deported by Canada in 2002 but remained a fugitive until his arrest last year.
In a court filing Wednesday, prosecutors said Legault and a co-conspirator, Alphonse Joseph Demots Jr., started an international food commodities business in south Florida in 1980. They moved to the New Orleans area after a deal to sell Mazola corn oil to a company in the Middle East fell apart, with the two accused of selling a cheaper product with fake Mazola labels.
In 1981, prosecutors said, Legault and Demots were using aliases and operating their business out of an apartment in suburban New Orleans when the Egyptian government agreed to buy 5,000 metric tons of frozen chicken from them.
After a bank wired more than $7 million to Legault's corporate account, he created fake documents to make it appear that the chicken was aboard a Swedish vessel bound for Egypt and transferred $1.5 million of the money to a Grand Cayman Islands bank account, prosecutors said.
Legault and Demots used some of the $7 million to buy 3,200 metric tons of chicken from a poultry farm in Mississippi to make it appear that they were honoring their contract, but Egypt refused to accept the partial shipment because it was late and wasn't what they promised to deliver, according to prosecutors.
"During this same period, Legault and Demots were involved in other fraudulent international-food commodity-contract schemes with Middle Eastern countries and/or companies," prosecutors wrote. "Once Legault and Demots had secured the proceeds from these commodity sales, both defendants left the New Orleans metropolitan area."
Legault moved to Montreal with his Canadian wife and successfully opposed extradition by the U.S. until Canada ordered him deported in 2002. He had a false identification under the name Carl Lavigne in his possession when he was arrested last year, prosecutors said.
A spokeswoman for U.S. Attorney Jim Letten in New Orleans said Demots pleaded guilty in 1983 to a related federal conspiracy charge in Detroit.
Legault, who is scheduled to be sentenced on Oct. 7, pleaded guilty Wednesday to charges that include conspiracy to commit wire and mail fraud and carry a maximum of 10 years in prison.
However, his plea agreement calls for him to serve a maximum of seven years in prison and pay a fine of up to $15,000. He can withdraw his guilty pleas if U.S. District Judge Kurt Engelhardt refuses to sign off on the deal. Engelhardt said he will review a report prepared by the probation department before he passes judgment on the plea deal.
The plea deal also calls for federal prosecutors in Houston to drop 26-year-old charges against Legault "related to a similar scheme," Assistant U.S. Attorney Harry McSherry said.
But the agreement doesn't resolve a case against him in Florida, where he awaits a trial on charges he conspired to swindle about 300 elderly investors out of millions of dollars.
While living in Canada, Legault was one of seven people charged in 1997 in Volusia County, Fla., with racketeering. Between 1993 and 1996, Legault and others allegedly conspired to lure victims into investing about $11 million in unregistered securities.
Legault's lawyer, Robert Glass, declined to comment following Wednesday's hearing.

Closing the gap: Gender-Based Violence in South Africa

http://www.plusnews.org
In a country long sickened by the frighteningly high level of sexual violence, one of the greatest challenges facing South Africa is closing the gap between the rhetoric of gender equality and the reality on the ground. The prevalence of gender-based violence is reflected in stark statistics: between April 2004 and March 2005, 55,114 cases of rape were reported to the police. The number of actual cases was likely much higher, considering only an estimated one in nine women report cases of sexual assault, according to the Medical Research Council (MRC). The MRC also estimates that a woman is killed by her intimate partner every six hours.South Africa has been hailed for its progressive constitution, which enshrines gender equality, and the number of women in parliament has risen substantially since 1994, creating a formidable force for legislative change.Changing laws can be swift; changing the mindsets that often nullify these impressive gains is another issue altogether. A culture of violence, born of years of political struggle against apartheid, has been blamed for the grim statistics, but women's groups also point to the persistence of patriarchal attitudes that view women as inferior to men.Part of the problem appears to be that many South Africans still have difficulty in defining rape. A 2004 nationwide survey of boys and girls aged between 10 and 19 found that 58 percent did not view "forced sex with someone you know" as sexual violence; another 30 percent of all respondents agreed that "girls do not have a right to refuse sex with their boyfriend".Vusi (not his real name), who used to physically abuse his partners before he discovered he was HIV positive and began receiving counselling and education on gender issues, explained the phenomenon to PlusNews."If a woman says no, as a man, you think - especially if she's someone you've been in love with or somebody you've paid a lobola [dowry] for - you think she is sleeping with someone else and you'll force yourself on her. I didn't even think of it as rape. To me it was a right thing to do - because she's mine, I have to sleep with her. Now I know that "no" is no and I don't have to question it because if she doesn't feel like it, she doesn't feel like it."Experts have described South Africa's unacceptable levels of gender-based violence and its 5.5 million HIV infections as interlinked epidemics, with behaviour change the key to both.As in many other parts of the world, poverty and unequal power relations between men and women often shape the nature of sexual relationships. One in four women experience domestic violence in South Africa - how can they suggest using a condom, knowing the suspicion and anger this might provoke?Researchers in the northern province of Limpopo targeted poor women, providing them with microcredit and education on gender and HIV/AIDS. After two years of involvement in the intervention, their experience of physical and sexual violence was reduced by half, compared to a control group of women from villages that did not participate in the intervention. The women's levels of economic wellbeing also improved, they were more self-confident, had greater influence in household decisions, and were challenging traditional gender norms.Despite the alarming levels of rape, women are still not accessing drugs to prevent HIV infection after being raped. Phindile Madonsela, 35, and HIV positive, conducts awareness sessions in schools. She was raped when she was 17 years old by someone she knew, who threatened to kill her if she reported the rape. "I disclose my rape at schools when I do HIV and AIDS education. I tell them they must report rape; they mustn't be like me and just keep quiet. Now ... there's this thing of HIV and AIDS, so if they report it, at least they can get PEP [post-exposure prophylaxis]."PEP is a course of antiretroviral drugs that can reduce the risk of contracting the HI virus from an HIV-positive attacker by as much as 80 percent if it is started within 72 hours of exposure. The new sexual offences bill, expected to be passed in early 2007, mandates designated public health facilities to provide rape survivors with PEP, but does not mention other treatment or counselling services; it also makes access to PEP drugs dependent on the survivor laying criminal charges. Advocacy groups have described the proposed legislation as a step backwards. There are also concerns that some sexual assaults of women might be driven by prejudice against their sexual orientation. Funeka Soldaat, a lesbian activist from Khayelitsha, a township about 30km west of Cape Town, was gang-raped by four men, who told her they would make her "a real woman". She believes many similar cases are not being reported out of fear of secondary discrimination by officers of the law.

Ecureuil fatal
